Purpose of processing

The vendor that you intend to work for (“Your Vendor”) is committed to maintaining a safe and secure environment for all customers and employees and, to that end and to the extent that it is proportionate and necessary, Your Vendor conducts background checks. Amiqus Resolution Limited. in Edinburgh, Scotland, United Kingdom (“Amiqus”) has been engaged to conduct the background check on Your Vendor’s behalf as a processor.

With this document we would like to inform you about the background check procedure and the personal data which is processed during the background check. Some elements of the background check may require Your Vendor to request information or documents from a third party, e.g. an authority. With this document we also seek your consent to the disclosure of such documents and information to Your Vendor as further explained below.

Categories of personal data

The background check may comprise of the following categories of personal data, as applicable to the job for which you have applied and insofar as this is necessary in order to assess your suitability for this job:

  1. a check of a terrorist and sanctions list;
  2. a check of and/or obtaining a copy of your educational credentials; 
  3. a check of your past employment history and possible reference checks with former employers; 
  4. a check of any licenses that you hold that are applicable to the job for which you are applying, e.g. driver’s license, business and professional license; and
  5. an unspent criminal record check of your current country of residence and all countries where you have lived for more than a year in the last seven years (“Residency Countries”), where permissible. 
  • When applicable, you agree to give Your Vendor your basic disclosure criminal record certificates from the relevant Disclosure and Barring Service in the UK, or the equivalent certificates from other Residency Countries where that is relevant. These certificates should be dated within 90 days of receipt by Your Vendor. 
  • If requested, you agree to provide Your Vendor with details of any unspent criminal convictions. You are not required to provide Your Vendor with information about spent convictions.  
  • You also give permission for an unspent criminal records check to be conducted by Amiqus, where applicable.

Processing of your personal data is required for Your Vendor to maintain a safe and secure environment for all of its staff and customers and in order to engage you. 

You acknowledge that failure to participate and assist with the process to the extent so reasonably required may result in Your Vendor not pursuing the application process. Any information that you provide in connection with Your Vendor’s background checking process shall be correct and complete in all respects. You understand that any falsification or misrepresentation of relevant information on your part (or any omission of relevant information) may result in the termination of the application process or engagement. 

Recipients and transfer of personal data

Amiqus Resolution Limited. in Edinburgh, Scotland, United Kingdom (“Amiqus”) is a third-party service provider engaged to conduct and assist on the background checks described above on Vendor’s behalf. Your information will therefore be transferred to and accessed by Amiqus in the United Kingdom insofar as this is necessary to prove your suitability for the engagement as well as for audit purposes. Your Vendor may also transfer the results of the background check to customers (e.g., Amazon) to whom you are supposed to provide services to, but solely on a “pass/not pass” basis. Transfers are, when relevant, based on EU/ UK Standard Contractual Clauses to ensure appropriate safeguards are in place to protect your personal data. Security and retention

All personal data collected by Your Vendor and Amiqus as part of the background checks referred to on this form will be kept confidential and used exclusively by Your Vendor and Amiqus acting on its behalf for assessing and proving your suitability for the job and (insofar as this is permitted under applicable law). 

Your Vendor and Amiqus will retain your personal data for as long as your application process and any following contract with Your Vendor remains valid.

Your rights as a data subject

You have the right to request access to, correction or deletion of your personal data, and to ask for data portability and the restriction of processing. You are also entitled to object to the processing of your personal data in certain circumstances. To make a data subject request, please contact Your Vendor. You also have the right to lodge a complaint with the data protection authority.
